LAST WILL AND TESTAMENT OF ANSOLME BAYLY

The Last Will & Testament of Anselene BAYLY Pved in Court by the oath of Tho.? WHITE & Ni. PASFIELD & a Pbate granted James BOYCE who married Eliz. his wife the Extx. therein named. Whereas by the last Will & Testament of Anselene BAYLY deced he hath given severall Legacies to his seven Children & James BOYCE who married Eliz. the Exx. of the said deced Comeing into Court and tendering to the Court the Estates of John, Anselene, Jeane and Elizabeth Orphants of the said deced.

Mr. Robert RUFFIN is requested and appoynted to dispose of the said Orphants Estates to such Pson or Psons as he shall finde fitt who are at the next Court to appeare and give security for the same; And the said BOYCE also offering that he would keepe ye.

Estates of the other three Orphants of the said deced. and give Security for the same, viz: Walter, Robert? & William & Mr. Robert CAUFEILD & Wm. CLARY Entering themselves security for the said BOYCE's due paymt. of the said three Orphts. Estates according to ye. Will of their Deced. Father they are accepted & Ordered that they give Bond accordingly.

[BAILEY] Anselm Baileys  . . .  VA 1600-1800

The name "Anselm Bailey" is a unique name which in the 1500's, 1600's, and early 1700's may link Baileys of the same bloodline. As far as I can research the name in the 1500's to late 1600's it is present only in England and there only in Gloucestershire. And from the work of Joy Whaite (1994) it appears all the Baileys in the 1500's, 1600's, and 1700's in England bearing the name Anselm in IGI and other records can be traced back to two Gloucestershire Bailey families, one in Elmore Parish and one in Wheatenhurst Parish. These two families were probably related as the patriarch of the Wheatenhurst family was baptized in Elmore.

In the late 1600's two Anselm Baileys immigrated from England to Virginia. Both must have come from Gloucestershire, there was a 50/50 chance they were related, and the first could have inspired the migration of the second.

The first "Ansell Bayly" sailed from Bristol, Gloucestershire and arrived in Isle of Wight County about 1661. The restricted use of the name Anselm Bailey continued in Virginia with his descendants south of the James River. Donna Beers, who has extensively researched this Anselm Bailey and his descendants, has data that shows only his descendants used the name Anselm Bailey in that area. Other surnames south of the James used the given name "Anselm" but not other Baileys.

The second "Anselm Bayly" appeared in Virginia as a headright of Henry Waring in 1689. This Anselm probably ended up in New Kent north of the James River where his sponsor received land. The name Anselm Bailey appears throughout 1700's and into the 1800's in the New Kent-Henrico-Hanover county area. Based on usage of the name in England in Gloucestershire and in Virginia south of the James I expect the Bailey families north of the James River who used the name Anselm were related to each other.  . . .
